What is a Notice of Retention/Utah Retainage

What is a Notice of Retention and when should it be filed?

A Notice of Retention is filed in the Utah State Construction Registry by those providing Preconstruction Services.  A Notice of Retention must be filed within 20 calendar days after you FIRST furnish preconstruction services to a project.  A Notice of Retention can be filed before your work begins.  If the Notice of Retention is not filed, preconstruction lien and bond rights are lost.

What is considered Preconstruction Service?

Preconstruction Services are planning, designing, or assisting in the planning or design of an improvement or proposed improvement.  This includes consulting, site investigation or assessment, programming, preconstruction cost or quantity estimating, scheduling, feasibility review, procuring construction services and preparing a study, report, rendering, model, boundary or topographic survey, plat map design, plan, drawing, specification, or contract document. 

NOTE: A NOTICE OF RETENTION HAS NOTHING TO DO WITH RETENTION!
